Trekking, Tour and adventure actives in Himalayan region carry an inherent risk to life and goods. The natural calamities may cause injury and loss of life, which is beyond any control. Say Yes To Himalayas does its best to minimize all types of risks, discomfort and hazard to the best of their ability, yet there are chances of accidents, mishaps and deficiency in service.

The following listed statements are the  ‘Terms and Conditions that will guide the relationship between YOU ( might also be referred as ‘Client’ below ) and Say Yes To Himalayas ( might also be referred as ‘Us’ below ). By booking a trip with us, it is taken for acceptance that you have read the Terms and Conditions and are in agreement with it in full terms. On booking a trip with us, it is also taken for acceptance that you agree to be bound by the laid terms and conditions, the cancellation policy and certain limitations of liability. We, i.e You and Us will be guided by this Terms and Conditions to resolve any legal or other disputes that may arise during the trip.

Booking A Trip

All of our trips need to be registered for by filling up a registration form and following the booking processes and successful receipt of payments. A booking ONLY COMES TO EXISTENCE after we send a confirmation email from us stating the same. Before that, there is no existence and meaning of this Terms and Conditions.

Before a trip is booked by you, we are in no obligation of any sorts and may change the price, itinerary or service agreement of a trip, be it multiple times. Once a trip is booked, this Terms and Conditions stands valid, as our legal guiding rules.

The following details are required for booking with us:

  • The program’s name and duration.
    The number of Person for the Tour.
    Name and nationality.
    Date you wish to travel or flight arrival date and time.

Payment & Confirmation

Instructions for payment will be forwarded together with your quotation.
For confirming the trip with us you need to send us scanned copy of your ID proof along with 50% advance payment.
You can send us the Payment via Wire Transfer / Bank Deposit / NEFT Transfer.
When your transfer is done, please e-mail us a confirmation mail with your money transfer details, so that we can follow up your reservation efficiently.

Advisory:

  • Any delay from the customer’s side will lead to cancellation of trek/ tour/ adventure activities.
  • Trekking maybe cancelled due to some unavoidable circumstances i.e- weather condition, govt. notification, land sliding or any other natural calamity.
  • Say Yes To Himalayas reserves the right to discontinue, modify any trek, tour & adventure activities without assigning any reasons or without any prior intimation whatsoever.
  • Anybody found to be under the influence of alcohol or drugs medically or physically unfit (any serious ailment, weak heart conditions, epilepsy, asthma, expecting mothers etc.) unfit for any reasons in the wisdom of the trek leader/guide/instructor will not be allowed for trekking /tour/ adventure activities. Request for a refund or a discount in such situation will not be entertained. Decision of the trek lead/guide/management in this regard would be final.
  • Total decided package cost will not be affected if there is any reduction in the number of persons
  • Minimum required 50% of amount to get confirmed the trek/tour/adventure activities.

Health And Fitness Requirements

Participants must be in good health and reasonable physical condition. It is vital that participants with medical problems make them known to us well before departure. If you suffer from severe muscular, chest, heart or bronchial disorders, or if you are a severe asthmatic, or have high blood pressure, you are strongly advised against participating. Expeditions generally take place in remote areas where there is little or no access to normal medical services or hospital facilities for serious problems. Where necessary, evacuation can be prolonged, difficult and expensive. Medical and evacuation expenses will be the responsibility of the participant.

TOUR / TREK LEADERS

Our Tour Leaders take their responsibilities seriously and if a Tour Leader believes in his/her judgment that you should not participate in the trip, before your departure, even if you pass your medical, he/she may exclude you from the trip. In this circumstance, you will be offered the option of taking another trip considered suitable for you or a full refund. If during a trip the Tour Leader considers you should not participate further he/she may direct you not to continue and you must follow the Tour Leader’s instructions. In this case, you will not be entitled to any refund.

MEDICAL CONDITIONS AND SPECIAL REQUIREMENTS:

All of our trips demands a certain level of fitness and medical health. For all of our trips, you need to fill our medical certificate with correct information. In any case, the information stated by you or your doctor in the medical certificate will be treated as correct, and we won’t be scrutinizing it. Say Yes To Himalayas has all the right to cancel or abandon a trip for the individual due to medical risks or fitness issues, before or in the middle of an ongoing trip. On such cases, no refund will be made for the remaining part of the trip cost whatsoever.

Some trips may be unsuitable for Clients due to age, mobility, pregnancy or physical or mental conditions. It is the Client’s responsibility to check prior to booking. Say Yes To Himalayas is not required to provide any special facilities unless it has agreed to do so in writing. The Company will do its best to meet Clients special requests, but such requests do not form part of the Contract and therefore the Company is not liable for not serving these special requests.

RESPONSIBLE TRAVEL

At Say Yes To Himalayas we believe in sustainable tourism through responsible travelling and it is one of our prime pillars of the organization. In all of our trip, we focus on keeping the mountains clean, benefiting the local community through our travels into their place and conservation of the natural flora and fauna of the place. We try to leave the mountains in better conditions than what we got into it. We make sure that in any case, we i.e our clients and staffs cause no harm to the environment at any cost. If possible and feasible, we even put voluntary efforts to clean the mountains and raise awareness amongst the local community. Irresponsible behavior with the environment will not be tolerated and we may also consider excluding the culprit from the group. In such cases, no refunds whatsoever will be made.

Visa, Health, Passport, Travel Documentation

Whilst we are able to provide basic advice/information to clients regarding passports and visa requirements, it will be your sole responsibility you are required to check/verify with the appropriate embassy or the consulate for the exact requirements for your chosen event and date of travel. We cannot accept responsibility for any failure to comply resulting in any costs or fines being incurred.

Local Laws & Customs

Laws and customs of the areas we visit can be very different to those we are used to. Be aware of your actions to ensure that they do not offend, especially if you are visiting religious areas. It is your responsibility to familiarize yourself with, and respect local laws and customs. If you fail to do so, we will have no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements.

Your Accommodation

Any accommodation we arrange for you, must only be used by those people named on your Confirmation Invoice. You are not allowed to share the accommodation or let anyone else stay there. You are responsible for the cost of any damage caused to your accommodation or its contents during your stay. These charges must be met by you and may have to be paid locally.

Special Requests

We will consider special requests such as dietary requirements or specific rooming arrangements when you book. We will tell you whether there is a charge for the request. We can only guarantee requests for which there is a charge, or those that are confirmed in writing. It is your responsibility to advise us of any special requirements through email after you confirm your booking.

One special request that we get on most of our trekking events is carrying of backpacks on mules / porters. We highly recommend that the personal backpack be carried by the participant themselves because your rucksack can be a life saver in the mountains when faced with unforeseen situations. However, in case a person is absolutely not able to carry or is feeling sick, he/she can offload by paying a charge as per the rates below:

INR 400 per bag* per day# when the logistics of the event are managed through mules

INR 800 per bag* per day# when the logistics of the event are managed through porters

* Each bag should not be more than 10-12 Kg in weight. This weight limit is a reference for maximum weight but bags shall be counted in number to calculate the charges.

# Partial offloading is not allowed i.e. number of days would be counted as the total duration of the trek/expedition no matter when you offload during the expedition. In case of expeditions where there are additional days required for reverse logistics, then 1 or 2 days may be added to the total duration of the expedition.

Participation Requirements

All clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen event as described in the itinerary. No unaccompanied minors (those under 18 years of age) can be accepted however minors aged between 10 -17 years may accompany their parent or guardian who accepts full responsibility for them. Anyone suffering from mobility impairment, illness or disability or undergoing treatment for any physical or mental condition, must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the event. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the event in which case all monies paid will be forfeit. All equipment issued to the participants at the start of any Trek/expedition should be maintained and responsibly used by them at all times during the Trek/expedition. Any damage or loss of equipment issued by SYTH to the participant, shall make the participant liable to compensate for the loss/damage.

CHANGES IN THE ITINERARY

Please note that mountain adventures are always unpredictable. Bad weather in mountain regions can cause flight delays, road blocks, or getting stranded in one place, etc. In such cases, we will be required to change the itinerary as per the situation. The itinerary will be changed with the best intentions to complete the trip as much as feasible, for everyone in the team.  Such changes will always be made to keep the total number of days in the trek to be unchanged, If for any case, where the number of days increases, extra cost for the day needs to be borne by the clients for the extra days. The amount will be calculated by SYTH office/staffs. In no case any refund will be made if the trip is cancelled in the middle due to situations beyond our control. However, every effort will be made to adjust the remaining days to change to some other itinerary.
Moreover, SYTH does not accept any responsibility for costs incurred as a result of missed flights, trains or buses, but would assist to make alternative arrangements wherever possible. Please also note that while on the field, we may have to make some changes in the itinerary due to unforeseen circumstances.

DOCUMENTS TO BE CARRIED

You must carry a valid photo identity card like passport, voter’s ID or aadhar card. These documents might be required for issuing various permissions required to travel. SYTH is not responsible for the safety of these documents, It is advised that proper care be taken to protect your documents from getting damaged due to rain, theft, misplacement, etc. Also, please carry 2 passport sized photos. Many permits require them. It will only be used when required.

INJURIES AND EVACUATION

SYTH would not be financially liable for any injury/health conditions/emotional or other conditions suffered by the client during the trip. Similarly, our package cost does not include any personal insurance. We advise the clients to take adequate insurance packages, including medical emergencies and evacuation by Helicopter, wherever available and required.
However, SYTH will take all the necessary care required to take care of any injuries. The team will be accompanied by a Team Leader who will handle required first aids and work out the evacuations.

SERVICES MISSED OR UNUSED

There will be no discounts or money refunded for missed or unused services, this includes voluntary or involuntary termination/departure from tour, i.e. sickness, death of a family member etc, late arrival on the tour, or premature departure either voluntarily or involuntarily.

THEFT ON TRIP

SYTH will not be responsible for any theft or loss of personal belongings on the travel duration. It is upto the client’s  top take care of their personal belongings. However, SYTH will try their best to act to the situation, but not legally liable to do so, by taking proper actions including reporting to local police administration, talking to locals, etc. A travel insurance taking care of theft on tour is advised for this matter.

UPDATING OF TERMS AND CONDITIONS:

Say Yes To Himalayas reserves the right to update and amend these terms and conditions at anytime. It is the responsibility of the Client to keep updated with any changes. The current version of terms and conditions will always be found on the website www.sayyestohimalayas.com and will be the terms referred to in any dispute.
